Terms & Conditions for THE BOX

 


1.    DEFINITIONS
•    “Osteology Foundation” means the Osteology Foundation, an independent non-profit organisation, in Platz 10, 6039 Root D4, Switzerland.
•    “THE BOX” refers to all digital platforms and services provided or controlled by the Osteology Foundation, including but not limited to:
o    Identity & Access Management (IAM);
o    Customer Relationship Management (CRM);
o    Learning Management System (LMS);
o    Grant Management System;
o    Event Management App;
o    Official Websites and Portals (incl. user self-service portals).
•    "The Box" means mybox.osteology.org.
•    "You", "your" and "yours" means the person(s) accessing the Osteology Digital Landscape.
•    "We", "us" and "our" means the Osteology Foundation.
•    "Material" means any information, data, text, graphics, links, programming code or other material published, contained or available on The Box.
•    "Your Content" is any and all the content submitted or uploaded by registered users, including names, images, photographs, video clips, biographical information, text, logos, marks and any other information and materials.
•    “Terms and Conditions” means the terms and conditions set out below.

2.    CHANGES
We reserve the right to change these Terms and Conditions at any time. Please check back regularly because the amended Terms and Conditions will apply to your continued use of THE BOX.

3.    MATERIAL ON THE BOX
Whilst every care is taken in compiling the information on the THE BOX, we do not make any warranties or representations as to its accuracy or reliability. We may make changes to the Material at any time without notice. Certain information may contain typographical or other errors or be out of date, and we make no commitment to update such information. We and any third parties referred to assume no responsibility for how you use the information provided.

The Material and all educational content made available through THE BOX, including courses, webinars, recordings, publications, presentations and other learning resources, are provided solely for informational and educational purposes.

The Material is intended for healthcare professionals and researchers and is not intended for patients or the general public. It is designed to support professional education and continuing learning and does not constitute medical advice, clinical recommendations, diagnosis, treatment instructions, or a substitute for professional training, supervision, clinical judgment, or independent assessment.

The surgical techniques, procedures, treatment concepts and clinical approaches presented reflect the knowledge, experience and opinions of the respective faculty members and authors at the time of publication or recording. Clinical decisions must always be based on the individual patient's condition, current scientific evidence, applicable laws and regulations, and relevant institutional protocols. Healthcare professionals accessing or using the Material remain responsible for the care and treatment of their patients and for determining the appropriateness of any procedure, technique or treatment in their particular clinical setting.

The opinions expressed in the Material are those of the respective authors and contributors and do not necessarily reflect the views of the Osteology Foundation, its employees, partners, editors, sponsors or publishers.
References to products, materials, techniques, technologies or manufacturers are provided solely for educational purposes and do not constitute an endorsement, recommendation or warranty by the Osteology Foundation.

The Osteology Foundation requires faculty members, authors and other content providers to confirm that any patient images, videos or clinical information included in the Material have been appropriately anonymised or are used with all required patient consents and authorisations.

4.    LINKS
Where we provide hypertext links to other websites, we do so for information purposes only. We are not responsible for the content of any other websites or pages linking to or from the Osteology Digital Landscape. We have not verified the content of any such websites and links to other websites do not imply any endorsement of the material on those Websites. If you choose to follow links to other websites you do so at your own risk. It is your responsibility to take all protective measures to guard against viruses or other destructive elements.

5.    USE OF THE OSTEOLOGY DIGITAL LANDSCAPE AND COPYRIGHT
You may access the Material as long as you comply with these Terms and Conditions and:
•    you use the Material for information purposes and for your non-commercial, personal learning and professional development purposes only; you are granted a limited, revocable, non-exclusive, non-transferable licence to access and use the Material for these purposes;
•    all copyright, trade mark and other proprietary notices are kept on the Material; and
•    you do not modify, reproduce, display, distribute the Material or perform the Material for any public use without prior written consent from the Osteology Foundation.

If you wish to reproduce, distribute, share, publish or otherwise use any Material beyond the permitted personal use described above, you must obtain prior written permission from the Osteology Foundation by contacting info@osteology.org. All copyright, trade mark and other proprietary notices are kept on the Material.

Certain Material (e.g. video recordings, e-learning modules) may be protected by third-party intellectual property rights. Such Material may not be reused or distributed without the permission of the respective rights holder.

6.    SERVICE ACCESS

We aim to ensure the availability of THE BOX at all times but accept no liability if it becomes temporarily or permanently unavailable. Access may be suspended without notice due to system failure, maintenance, or circumstances beyond our control.

7.    LIABILITY

We reserve the right to modify or discontinue any service without notice. We are not liable for any loss or damage, including but not limited to loss of income, profits, data, or goodwill, resulting from your use or inability to use the Osteology Digital Landscape. You are responsible for protecting your systems against potential risks associated with accessing our platforms.

To the fullest extent permitted by applicable law, the Osteology Foundation shall not be liable for indirect or consequential losses arising from reliance on educational content or from temporary interruptions to the digital platforms. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited. Users acknowledge that they are solely responsible for evaluating and applying any information obtained through the Osteology Digital Landscape.

8.    REGISTRATION

To access certain features, you must register using a verifiable email address and complete the registration form truthfully. Accessing restricted areas implies acceptance of these Terms.

9.    ELIGIBILITY 

Use of THE BOX is intended for professionals in the field of oral regeneration, aged 18 and over. By using THE BOX you warrant that: all registration information you submit is truthful and accurate; you will maintain the accuracy of this information; your use does not violate any applicable law or regulation; you are 18 years of age or older; and you are a professional working in the field of oral regeneration, or you are somehow connected projects, for which you have to access this page (e.g. agencies, assistants, professional partners, etc.). We reserve the right to terminate your membership without warning if we believe that you violate any of these rules.

Certain courses, grants, events or educational activities may be subject to additional eligibility criteria, including academic qualifications, professional credentials, membership requirements or other prerequisites as specified in the relevant programme description.

10.    USERNAME AND PASSWORDS

By registering, you promise to keep your password secret and not to disclose or share it with anyone. If you believe that someone else may have access to or know your password you must immediately change it.

11.    SUBMISSION OF CONTENT
As a Registered User you may share content to THE BOX as long as you comply with our Content Standards (see below) and Terms and Conditions. You grant us a perpetual, royalty-free, non-exclusive licence to use Your Content on the Osteology Digital Landscape.
This excludes Content that you submit when applying for an Osteology Grant. All grant application will be treated confidentially, and only the reviewers and administrative staff necessary for the reviewing process will have access to the Content submitted.
You agree that before posting or uploading Your Content you are responsible for obtaining all releases, consents and/or licenses necessary for uploading Your Content on our Website and for any subsequent use of that content by us in accordance with these Terms and Conditions.
You promise that you are the person depicted in any images or recordings submitted as part of Your Content and if you upload any images or recordings of any third party, you have obtained the prior written consent of that party to submit such content to the Osteology Digital Landscape.
•    does not infringe any copyright, trademarks, rights of privacy/confidentiality, publicity or other intellectual property or other rights of any other person or entity;
•    does not contain any information about any person(s) unless you have permission from them;
•    does not contain malicious code, viruses or other harmful programs or material;
•    does not violate any applicable law, statute, ordinance, rule or regulation; and
•    meets our Content Standards (see below).

12.    CONTENT STANDARDS

You agree whenever you submit Your Content to our Website or contact other users you must comply with our Content Standards. 
You agree Your Content must be accurate where it states facts and be genuinely held where it states opinions.
You agree Your Content must not:
•    contain any material which constitutes or encourages conduct that could be considered a criminal offence, give rise to civil liability, or otherwise be contrary to the law;
•    contain any material which is defamatory;
•    contain any material which is obscene or offensive;
•    infringe any copyright, database rights, trade mark or other intellectual property right or other right of any other person;
•    be likely to deceive any person;
•    be made in breach of any legal duty owed to a third party such as a contractual duty or obligation of confidentiality;
•    be likely to harass, upset, embarrass, alarm or annoy any other person;
•    be likely to disrupt our service in any way;
•    give the impression it emanates from us where this is not the case; or
•    advocate, promote or assist any unlawful act, for example copyright, trade mark infringement, or computer misuse.
In addition, users must communicate respectfully and professionally when participating in discussions, forums, collaborative activities or other community features of THE BOX.

Content primarily related to political campaigning, unrelated commercial promotion, confidential business information, or identifiable patient information without appropriate authorization is not permitted.

13.    USE OF YOUR CONTENT

We reserve the right to reject, block, suspend or remove Your Content at any time at our sole discretion. We in no way guarantee that Your Content or any part of it will be displayed on The Osteology Digital Landscape. Any content is published at our discretion.

14.    PRIVACY POLICY

Your personal data will not be shared or disclosed beyond the purpose for which it was collected. You can update your preferences or delete your account at any time: mybox.osteology.org

15.    COURSE FEES, CANCELLATIONS AND CERTIFICATION 

Fees
Where applicable, registration fees for courses and educational activities are displayed at the time of registration and are charged per participant. A place is confirmed only once the registration has been completed and full payment has been received.  Registrations are handled on a first-come, first-served basis (decisive is the date of registration and payment) and are only valid for the selected course or educational activity and the specified year. 

The Osteology Foundation reserves the right to modify fees for future registrations at any time. Changes shall not affect registrations that have already been confirmed and paid. 

Payments may be made using the payment methods offered during registration. Participants are responsible for ensuring that all payment information provided is accurate and complete. Payments may also be completed using a valid voucher code issued by the Osteology Foundation. Unless otherwise specified, these Terms and Conditions apply equally to registrations completed using vouchers.

Fees are charged in the currency displayed during the payment process. Applicable taxes, including VAT where required, will be displayed at checkout. Payment transactions are processed by an authorised third-party payment provider. While reasonable security measures are implemented, to the fullest extent permitted by applicable law, the Osteology Foundation shall not be liable for unauthorised access, interception, fraud, hacking or other misuse of any information transmitted over the internet resulting from circumstances outside its reasonable control.

Cancellations and refunds
Unless otherwise stated, self-paced online courses and subscriptions become accessible immediately upon registration and payment and are non-refundable, except where a refund or withdrawal right is required by applicable mandatory law.

Unless otherwise specified in the description or registration information of a particular educational activity, the following cancellation policy shall apply to in-person educational activities: cancellations received more than eight (8) weeks before the scheduled start date are eligible for a full refund of the registration fee. Cancellations received between eight (8) and four (4) weeks before the scheduled start date are eligible for a refund of fifty percent (50%) of the registration fee. No refunds will be granted for cancellations received less than four (4) weeks before the scheduled start date. For registrations made using a voucher issued by the Osteology Foundation, a cancellation fee of CHF 500 may be charged where cancellation is received less than four (4) weeks before the scheduled start date. The Terms & Conditions, including these cancellation conditions, will be clearly linked during the registration process.

Certain educational activities may be subject to specific cancellation terms. Where a specific cancellation policy is stated in the activity description, registration form, or other activity- or event-specific documentation, such specific cancellation policy shall prevail over the general cancellation policy set out above.

The Osteology Foundation may, at its sole discretion, grant exceptions to the above cancellation policy in cases of force majeure or other exceptional circumstances, including illness, supported by appropriate documentation.

The Osteology Foundation reserves the right to cancel, postpone or reschedule courses or educational activities. In such cases, the tuition fee paid for the affected activity will be refunded in full. No further compensation, damages or indemnification shall be payable.

Certificates
For on-demand online courses and recorded educational content, participants may be required to view the available video content and successfully complete any associated assessment(s) before a certificate is issued. Specific completion requirements may vary by educational activity and will be communicated on the relevant programme page in this case.
Participants are responsible for duly completing all required learning modules, assessments and certificate requirements associated with a course. Where applicable, certificates will be issued only after successful completion of the specified course requirements.

Certificates of participation or completion do not in themselves confer any professional qualification, licence, specialist status, clinical privileges or authority to practise unless expressly stated otherwise.
 
16.    NEWSLETTER

By  subscribing to our newsletter you  agree to receive emails from us. The aim of our newsletter service is to keep users of our community updated about new content, events and topics. When you register to THE BOX you subscribe to our newsletter. The email preferences can be updated at any time using the link at the bottom of our emailings.

17. THIRD-PARTY SERVICES

THE BOX may include or integrate software, platforms, or services provided by third parties (e.g. learning management systems, CRM tools, event platforms, or grant submission portals). These third-party services may be governed by their own terms of use and privacy policies, which apply in addition to these Terms. We are not responsible for the content, availability, or data handling practices of third-party providers. It is your responsibility to review and comply with the terms and privacy policies of any third-party services you access via the Osteology Digital Landscape.

18. GOVERNING LAW

These Terms are governed by Swiss law. Any disputes shall fall under the exclusive jurisdiction of the courts of Lucerne, Switzerland.
